The question is whether he was acting in the performance of his official duties. His argument will be that he was simply informing the crowd that, as President, he was thoroughly convinced the election was rigged and that they should walk "peacefully" (the word he used) to the Capitol to demonstrate. He will argue that he was carrying out his absolute duty to urge and influence Congress to reject the "fraudulent" results. He never exhorted anyone to storm the building, much less vandalize it, fight the police, and threaten Congress. If the Trumpy Supreme Court buys that argument, he's home free. |
