There's no doubt he was still President. The question is whether he was acting in the performance of his official duties.

His argument will be that he was simply informing the crowd that, as President, he was thoroughly convinced the election was rigged and that they should walk "peacefully" (the word he used) to the Capitol to demonstrate. He will argue that he was carrying out his absolute duty to urge and influence Congress to reject the "fraudulent" results. He never exhorted anyone to storm the building, much less vandalize it, fight the police, and threaten Congress.

If the Trumpy Supreme Court buys that argument, he's home free.

I finished a blog post that is general observations about the signs carried in these anti-Drumpf marches, and it occurred to me that someone else might also think they'll end up in a museum some day. Maybe tRump should take War-fare-in' instead of his extra doses of aspirin - i.e. his "more is better" strategy of taking more than the dose prescribed by his doctor.

The blood thinner medication called Warfarin has a side effect of increasing blood loss which endangers lives if an injury occurs. And you have to admit the name is appropriate for a President intent on war-faring in as many countries as he can. (I am sure that RFK Jr would approve of him taking that medication. NOT!)
