Subject: Demo contents, is it OK to use...? From: Deni Date: 18 Mar 01 - 08:07 AM Hello all, Mad Rush is making a demo. On it will be some of our own stuff, some trad.songs and some contemporary. Is it OK to add one or two of our favourite songs by other songwriters? i think I read somewhere that it is OK as long as the tapes are not for sale. Also, if you did, say, an Eric Bogle song at a gig, would that be OK. I know people do this sort of thing all the time, and there's lots of advice flying around, but I'm still not clear on the details. It is the venue that has to be paying a license for live performances, isn't it. Hopelessly confused and desperate from Devon. |

And I think the way copyright law works, is that once a song has been released, you can record it, you just have to obtain the permission and pay the royalties on your sales. The only way they can refuse you the use of the song, is if you have altered it not to their liking (unfriendly amendment, I guess you'd call it.) Ergo, a bunch of Stan Rogers unreleased songs were unavailable to other artists until they were put out last year on "Coffee House to Concert Hall; I think the only person who was given permission to record an unreleased Stan song was Tom Lewis who did "Down At The Sailor's Rest". I could be wrong about most of this though, not being an international music copyright lawyer anymore... Willie-O |
