Subject: RE: Tune Add: Miss Rowan Davies:Phil Cunningham From: Declan Date: 13 Mar 08 - 05:35 PM Thanks from me too. I heard this tune a number of times in sessions and asked the name but I haven't had a source to hear it until now. I'll be trying to work out how to play this over the next few days. |

Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: GUEST,Jack Campin Date: 07 Feb 09 - 10:33 AM My understanding is that Phil Cunningham does NOT take kindly to having his tunes reproduced without permission, and this one in particular. It's in his book. Remove it somebody, please. |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Mr Happy Date: 08 Feb 09 - 07:05 AM ........& while yer at it remove all the songs & tunes on this & all other websites that anyone can access! |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Jack Campin Date: 08 Feb 09 - 07:11 AM There is no excuse for plagiarizing something that you know is copyrighted and where you know the composer actually does object. Some copyright holders object, some don't. Some object to free reproduction of some of their stuff but are okay about others (see Paul Cranford's site for examples). In this case we know EXACTLY what Phil thinks about what you're doing. Buy his book if you're interested. I did. |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Mr Happy Date: 08 Feb 09 - 07:32 AM Ok, the ABC is from the Session, tunes fron You Tube, all accessible by anyone, so who's the perp? |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Jack Campin Date: 08 Feb 09 - 07:53 AM That's about the level of morality I'd expect from the average TheSession user. We don't generally sink to that level of scumminess here. |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Mr Happy Date: 08 Feb 09 - 08:32 AM A personal attack now? |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Tootler Date: 08 Feb 09 - 10:02 AM Mr Happy, Like it or not, Jack Campin is right. Phil Cunningham as the composer of the tune owns the copyright and so has a say over where and when the tune may be reproduced. You may have seen copyright notices on publications and they usually say something about not reproducing without permission, which it seems to me is what you have done. Don't forget that Phil Cunningham depends on his music for his living. |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: GUEST,Johnmc Date: 08 Feb 09 - 10:02 AM I have often wondered what exactly constitutes reprodoction. If I were to sit with a pencil and jot down a melody by ear for my use only, would this be an example? Or does it have to be mechanically reproduced? If the former is not legal, I can't see how you could police it. |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Mr Happy Date: 08 Feb 09 - 10:28 AM THE MUSIC I'LL POST HERE WILL BE THINGS YOU MIGHT NOT HAVE HAD ACCESS TO IN THE PAST.[Phil Cunningham] Source:http://www.myspace.com/philcunningham |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Malcolm Douglas Date: 08 Feb 09 - 11:04 AM I'm not sure in what way that is relevant. If Phil Cunningham chooses to publish his own material via MySpace or anywhere else, that's his right; though I see no obvious sign that he has included notation for 'Miss Rowan Davies' or any live performance of it there; or that he intends to. Perhaps I just haven't spotted it. In any case, that still wouldn't make it ok to reproduce the material anywhere else without his consent: a link would serve perfectly well. 'GUEST,Johnmc's question, though doubtless genuine, is a reductio ad absurdam, and as such potentially misleading. 'Reproduction' in this context means public reproduction: that is, publication. Placing a transcription of a piece of music on a publically accessible website, for example, constitutes publication. The nature of the internet makes it virtually impossible to enforce copyright unless you are a large corporation, but that doesn't mean that it's ok to ignore the moral issues involved. In the majority of cases relating to folk music, the copyright holders don't mind their material being copied on websites like Mudcat provided it's done accurately and with proper attribution(s); but some do, and their wishes must be respected. The question of placing a video of a live performance on (for example) YouTube is a different one. I can't comment on the legal position, but would note that, at the very least, common courtesy requires that the person making the recording obtain permission from performer and/or venue/promoter at the time of making it; and, subsequently, for publishing that recording; though clearly many don't bother. |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Wolfhound person Date: 08 Feb 09 - 03:04 PM What Tootler & Malcolm Douglas & Jack Campin said. The guy is known to be touchy about unauthorised publication of his music. So don't do it. Paws |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Joe Offer Date: 08 Feb 09 - 09:49 PM Well, here's our policy. We ask people to post whatever they like, and let us handle the copyright issues. Please don't argue about your speculations over what Mr. Cunningham likes or doesn't like. If Mr. Cunningham has any objection to something of his being posted at Mudcat, we will gladly remove it if he contacts me or Max directly. Thanks. -Joe Offer- joe@mudcat.org Mudcat's owner, Max Spiegel, is max@mudcat.org |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Mr Happy Date: 10 Feb 09 - 07:52 AM In relation to the above, I really don쳌ft see any difference in posting actual excerpts from already published, copyrighted works or links to them of any kind, whether they be bits of texts from research documents, libraries etc. Also, I쳌fm at a loss as to the allusion to plagiarism. The term means to copy another쳌fs work then pass it off as one쳌fs own for gain or otherwise. |
Subject: RE: Tune Add: Furusato From: Mr Happy Date: 29 Oct 09 - 09:59 AM Since playing the tune in various seshes around fests during the summer, its been pointed out to me how much the melody resembles a traditional Japanese folk song called 'Furusato' or 'My Hometown' A nice instrumental interpretation here:http://www.youtube.com/watch?v=6Y-3fQ8uCVg |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Jack Campin Date: 30 Oct 09 - 09:25 AM Is it likely that Phil heard the Japanese tune before writing Miss Rowan Davies, or is it just fluke? |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Mr Happy Date: 30 Oct 09 - 02:14 PM Many apologies to all! I've posted this in error, its not Miss Rowan Davies which bears a similarity to Furusato. I should've posted elsewhere that its actually Michael Turners Waltz which is similar. |
Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: Steve Shaw Date: 23 Sep 10 - 08:20 AM Is it OK to play this tune in a session without asking permission? We do... |

Subject: RE: Tune Add: Miss Rowan Davies (Phil Cunningham) From: GUEST,leeneia Date: 10 Apr 15 - 11:09 AM If composers would establish a simple and reasonably-priced method for paying them for their works, many people would. I would cheerfully pay Phil Cunningham $1 for the dots to 'Miss Rowan Davies.' However, he doesn't make it possible to do so. (My band played it in my living room several times one day. Then we moved on to other music. We agreed it was beautiful. Thanks, Phil) Last year I thought I might make a YouTube of 'Little Drummer Boy.' (YouTube had pages of warnings about not using copyrighted material, but absolutely no info on how to be legit.) After half an hour's searching, all I learned was that I had to telephone a woman in London (from the U.S.) to get permission. I decided to forget it. In contrast, bn Easter Sunday (last week) I decided I wanted to watch the old MGM movie 'Easter Parade.' I paid $2.99 through YouTube, put it on my credit card, and in five minutes I was watching it. That's what I call intelligent use of copyright. |
