Subject: RE: BS: man sued betting shop cos he lost From: GUEST,PMB Date: 12 Mar 08 - 07:38 AM There's a precedent: the Lloyd's "Names" (independent insurance underwriters - i.e. betting - on a tax scam) lost vast amounts of money in the 1990s, sued for it back, and won. |
Subject: RE: BS: man sued betting shop cos he lost From: Sandy Mc Lean Date: 12 Mar 08 - 07:58 AM Well you can never count out a strange court decision in your favour. A few years ago in Nova Scotia a fast food outlet was sued by someone who fell through the roof during a break-in attempt. The court awarded to the plaintiff, so you never know............ I suppose a suit is just another gamble that has its winners and losers. |

Subject: RE: BS: man sued betting shop cos he lost From: Ernest Date: 12 Mar 08 - 08:26 AM And then there is the story about the man who had his cigars insured against fire. After smoking them he sued the insurance company for the money - and won. Shortly thereafter he was sentenced to prison for malicious arson. |
Subject: RE: BS: man sued betting shop cos he lost From: GUEST,Jon Date: 12 Mar 08 - 09:16 AM Story here "He [the judge] ruled that although the company failed to take "reasonable steps" to stop Mr Calvert from telephone gambling, Mr Calvert's "pathological gambling" would still probably have led to his financial ruin. In summary of his ruling the judge said: "William Hill's failure to take reasonable care to exclude him from telephone gambling... did not therefore cause Mr Calvert any measurable financial or other loss." |
Subject: RE: BS: man sued betting shop cos he lost From: Uncle_DaveO Date: 12 Mar 08 - 10:22 AM The Lloyds names case is not particularly meaningful on the merits. The ruling had to do with procedures only, as I read the article. Dave Oesterreich |
Subject: RE: BS: man sued betting shop cos he lost From: Celtaddict Date: 12 Mar 08 - 11:29 PM Here in Connecticut I just read a story about a compulsive gambler suing the large casino nearby because they did not stop the gambler from losing large amounts of money. In an ideologically related lawsuit, a couple of years ago, a teenager was drunk and riding on the hood (or roof) of a moving car; the car went near the police station. The teen fell and suffered a severe head injury, and his parents sued the police for not stopping him from doing something stupid and dangerous. The same depressing story, of people who do not accept responsibility for their own mistakes, AND of people who think any mishap may be their chance to become rich. |
