just because a young girl refuses to testify does not mean
it did not happen!!

perhaps this incident happened before the statute of
limitations, so he may not be able to be tried for it,
but i hope it is included in the trial as an example of

I've just read the book "Picking Up The Pieces" by Paul Britton, criminal psychologist. It gives some insight into how people as dangerous and wicked, as Phillip Garrido appears to be, manage to get out of prison on parole. I'm going to read his book "The Jigsaw Man" next.

The Contra Costa County sheriff's deputy who responded to the complaint by the neighbor (Erika Pratt) (when she said she suspected that a woman and girls were living in the yard) was not aware that Garrido was a registered sex offender nor that he was on parole. Not having that knowledge, he wouldn't have had a reason to know that he could have searched the property without a warrant. The question is, why did he not have that knowledge? The answer would seem to be that (a) the county doesn't have procedures that a deputy must follow to check out the criminal record of the subject of a neighbor's complaint; or (b) the county does have such procedures and they were not followed.

What's more bizarre is that there was a surprise visit made to Garrido's home by a "multi-agency task force" as part of a sex-offender compliance check, and the task force searched the home but not the yard. The reason given is that 'no parole officer was part of the team, adding that such officers have greater search powers." Quote pulled from this LA Times story

From that same article: Gordon Hinkle, spokesman for the California Department of Corrections and Rehabilitation, says of his parole officers: "We were dealing with a criminal, and he and his wife were being very elusive. They were very deceptive and very stealthy in how they were keeping these individuals hidden." There apparently is a yard within a yard... but at least one neighbor (Pratt) saw through the "deception". Yet multiple parole officers on Garrido's case did not. The latest parole officer didn't get wise until Garrido very un-stealthily brought Dugard and her daughters to his office!

Basically, the various agencies are making excuses for themselves that sound lame as hell. Looks like Schwarzenegger and Obama are both going to have to appoint task forces to sort through this muck and make changes in state and federal procedures.

Yup, lotsa fingers pointing at him at the moment. I wonder, though, what the law says about the officer's need to get a warrant to search the property when the property owner is on parole.

Perhaps we could start with the neighbors who put up with the noise of the "parties" and the trash in the yard (and the stench of the trash?) and the overgrown weeds for 18 years... or with officials who failed to enforce ordinances about noise and yard-trash. Hard to believe that so many people could look the other way for that long.

What about all those friends, customers and business associates of Garrido's who took notice of his strange behavior without thinking that perhaps the young girls in his house needed to be protected from him?

Guess it all depends on how many witches one wants to hunt.

Which authorities in which state, Ebbie? Nevada released him from prison, but the imprisonment took place in California. What penalties can legally be levied against whom?

*frustrated arrrgghh* What will probably happen is that there will be a lot of interstate finger-pointing among/between agencies, none of which will ultimately benefit the Dugard family. The Dugards may have to file suit(s) to find any restitution. In the meantime, charities are amassing contributions for the victims (and schemers have already set up fraudulent on-line charity sites, so beware!).

So taxpayers will contribute money voluntarily to the Dugards AND they will have to contribute involuntarily toward the Garridos' incarceration, prosecution and court-appointed defense! Am I wrong? (Wish I were!)

Yesterday's news said that there was some concern as to how this family would pay for all the therapeutic counseling they will need.

My question: As it is glaringly evident that the county, if not the state, failed the long-ago abducted child, continuing the failure over many years, making them responsible for the subsequent events, including the two children, aren't the authorities vulnerable to high penalties? It seems to me that there should be millions involved.

Phillip Garrido, the man accused of kidnapping and sexually assaulting Jaycee Lee Dugard, was paroled by the federal government two decades ago after a 35-minute jailhouse interview in which he spoke of his crime, his prison experience and future plans, the U.S. Parole Commission said Friday.

Garrido, charged with abducting Dugard 18 years ago, was released from federal custody after serving only 10 1/2 years of his 50-year sentence for a 1976 kidnapping.

Cranston Mitchell, vice chairman of the U.S. Parole Commission, said two commission examiners met with Garrido in Lompoc, Calif., on Nov. 5, 1987, to discuss his possible parole.

Neither the federal prosecutor nor Garrido's defense lawyer attended the hearing, and the examiners may not have seen psychiatric reports on Garrido, Mitchell said.

They also may not have reviewed Garrido's trial record, Mitchell said. Transcripts would have showed Garrido said he had exposed himself to young girls and masturbated outside schools.

The prosecutor said another woman also identified him as the hippie-looking man who tried to kidnap her an hour before he succeeded in kidnapping the other woman.

Reading a summary of the parole report, Mitchell said Garrido planned to return to live with his mother in California. He had only two prior convictions, Mitchell said. Both were for marijuana possession in California in 1970 and 1972, and he was not incarcerated for the offenses, Mitchell said.

Garrido also had been arrested on suspicion of drugging and raping a 14-year-old girl in 1972, but she declined to press charges, authorities said this week.

The examiners also considered his prison experience. In an earlier bid for release, Garrido had blamed marijuana and LSD use for his crime, and said he had earned a high school diploma and learned carpentry and drafting behind bars.

"He was an average inmate," Mitchell said. "There were no major issues."

Two weeks later, the parole commission received the examiners' unanimous recommendation and voted to parole Garrido to a Nevada state prison to complete a sentence for raping the kidnap victim, a state offense.

A numerical formula used to determine an inmate's suitability for parole indicated Garrido should be released, Mitchell said.

That formula included scores for such factors as obtaining a high school diploma and the inmate's age when first imprisoned.

Garrido's score, which was used as a guideline by the government, showed he had been suitable for parole almost two years earlier, Mitchell said. But under the law at the time, Garrido was required to serve at least 10 years.

Federal parole was abolished in 1987, but the termination did not affect inmates already serving sentences.

The handling of Garrido was typical of the "old-fashioned parole system" that was overhauled by Congress in 1984, when sentences became longer and mandatory, with little judicial discretion, said Stanford Law Professor Robert Weisberg, who specializes in criminal law.

Under today's laws, Garrido probably would have served 20 to 40 years, Weisberg said. Today's parole boards also have more sophisticated ways to measure an inmate's risk to the public, he said.

In deciding to parole Garrido, the presidential appointees on the commission would have taken into account that Garrido had a potential life sentence to serve in Nevada state prison, Mitchell said.

Leland E. Lutfy, who prosecuted Garrido for the kidnapping, said the state judge who sentenced Garrido to serve a five-years-to-life sentence for rape concurrently with the federal sentence did so after being misinformed by the state prosecutor that Garrido would have to serve two-thirds of his federal sentence.

After Garrido entered Nevada state prison in January 1988, the Nevada state parole commission voted 3 to 2 to release him on Aug. 1, 1988.

A Nevada parole spokeswoman was unavailable Friday, but the Reno Gazette-Journal reported that the state board considered Garrido a "moderate" risk because he had never served jail time.

The newspaper reported that Garrido had been incarcerated in a Contra Costa County minimum detention "farm" for a 1969 drug conviction, which would have made him a high risk had the board known of it.

Three years after his release, Garrido is suspected of kidnapping Dugard from South Lake Tahoe, where he had kidnapped the 1976 victim.

The California Department of Corrections and Rehabilitation supervised Garrido for the federal government. But the agent who was assigned to him did not discover Dugard and her two daughters living on Garrido's property. The agent supervised about 40 parolees, officials said.

"Forty is a nice size" for a parole caseload, said Mitchell, who ran the parole system in Missouri for 18 years and formerly worked as a police officer. "Most places would love to have 40."

He said some parole agents are responsible for as many as 100 parolees.

Parole work is "driven by suspicion," Mitchell said. "And a lot of it is driven by their history -- not so much the type of crime -- but the history. For this particular individual, he didn't have any history" on paper because law enforcement considered only Garrido's prior convictions, not his admissions at trial.

Gordon Hinkle, a spokesman for the California Department of Corrections and Rehabilitation, declined to identify the agent who supervised Garrido.

Hinkle said the department is reviewing parole procedures as a result of the Garrido case, but stressed that his parole agent was not under any type of investigation.

Sorry I can't find a link right now, but yesterday news reported that his wife Nancy described driving around with him the day before the kidnapping, looking for the "right" girl with the looks that Garrido wanted. When they first saw Jaycee, Garrido chose her as the one he wanted, but she was with other children, so they returned the next day and waited at the bus stop area for the chance to grab her and pull her into the car.

The thing that SERIOUSLY freaks me out about this is the total delusion of Garrido and his wife. Seriously...pleading not guilty to the kidnapping? Sadly, I can picture a highly unethical lawyer trying to capitalize on the fact that Jaycee stayed and worked at the print shop all those years (theoretically having the opportunity to escape and not taking it). But how do they possibly expect to justify the kidnapping in the first place? How can any lawyer justify defending this plea?

And the fact that Garrido claims that the birth of his last child made him "turn his life around" and that people who talked to the victims were going to hear a "heartwarming, uplifting story"...this just makes me SO sick. Yeah, you turned your life around. Just not enough to, you know, make things right by reuniting Jaycee with her family.

AAUUGHH!!!

Garrido had his own cult religion going from the delusions about voices, manifestos, angels, god... that isn't unusual for a pedophile to also have what some researchers have called a "Mom & Pop cult". There are more small family type cult groups like this in the US than you can imagine. Our freedoms have the achilles heel of anyone being able to start their own religion. It's common that these types of cult leaders use undue influence, like he did on the child he kidnapped, to get those close to them to conform to his own religious delusions. As a child, in particular, she had no defense against that. Having lived under his control since age 11, there was probably in her mind no other way to live, so she would not even think of leaving, especially having 2 young daughters that he controlled, too.

The guy had one 50 year sentence and one 100 year sentence; I'm sure those who put him away never expected him to crawl around free in the world again. What excuse could the parole board possibly give?

Wondering why there are only the two offspring... I hope it occurs to the authorities to look into the possibility that Dugard was impregnated more than twice, and to look in the yard for the shallow graves of baby boys. Baby daughters, in Garrido's sick mind, were probably considered to be future sex objects, fit for his stable of corraled young females, but baby sons would only grow up to be a threat to him.

It seems unlikely that he would still be on parole from a 1971 conviction, so maybe we shouid give the federal parole officers the benefit of the doubt.

However, the 2006 incident where a neighbor called and said there were people being held in the backyard of the Garrido house should have resulted in (at least) in inspection of the backyard. The sheriff thinks so too:


"Contra Costa County Sheriff Warren E. Rupf said a neighbor reported three years ago there were people living in tents in a backyard encampment at the home of Garrido.

The deputy who interviewed Garrido in November 2006 gave him a warning that people living outdoors was a code violation. The deputy did not go into the backyard of the house located in an unincorporated area of Antioch, about 45 miles northeast of San Francisco, Rupf said.

More suspicion and curiosity on the deputy's part could have uncovered the secret encampment where Dugard allegedly was held, he said.

They "missed an opportunity" and there are "absolutely no excuses," Rupf said, apologizing to the Dugard family.

His father and brother did not defend or excuse what he did. They affirmed that he's a criminal. Remember, the guy served prison time for a previous kidnapping and rape and had a surveillance bracelet and was on parole. They knew what a monster he was and didn't want anything to do with him.

A head injury is likely to cause disability, not this type of psychosis.

Damaged goods he is, but there is no way that he should be absolved of guilt. Also, his wife did the most of the same crimes and she does not have the same motorcycle injury he claims.

Laurel, the interviews I've seen of his father and comments of his brother actually show to me that they knew since the kidnapper was a teenager that he had gone "crazy". His family feel like he "died" to them in a way since he was a teen and heavy into LSD and other drugs, not just the brain injury.

Jaycee Lee Dugard became so accustomed to life imprisoned in a secret garden in California that she helped run her kidnappers' family business.

The 29-year-old became the "front" for a printing company owned by Phillip and Nancy Garrido and run from their home in Antioch, near San Francisco. The prisoner dealt with its clients in person and by phone and e-mail. One customer of the firm, which printed business cards, described her as its "design genius".

Dugard was abducted as an 11-year-old from her home in South Lake Tahoe, in northeastern California, in June 1991. She reappeared last week when Garrido, a convicted rapist, walked into a police station to talk to his parole officer. He was accompanied by Dugard, the two daughters, aged 15 and 11, she bore him during her captivity, and by his wife.

Phillip and Nancy Garrido denied 29 charges including kidnap and rape in court in El Dorado county on Friday. The FBI has confirmed it is seeking evidence that Garrido, 58, murdered up to 10 women, including some prostitutes, in the San Francisco area in the late 1990s.
   
Dugard is said to be relishing her freedom and is planning a trip to Disneyland with her family. The first words she said when reunited with her mother, Terry Probyn, at a motel last week were, "Mom, I have kids."

This is so similar to that fellow in Austria who kept his own daughter in a basement apartment and fathered several children by her.

It doesn't take long to stray into realizing the monumental damage he did to these lives, when thinking about the existence this young woman and her two daughters experienced (she must have been 13 when he first impregnated her) and the vacuum that exists regarding their ability to think and function. What do they know of the world today? How, at these ages, do they successfully learn to read and write and have a "normal" social life?

It boggles the mind, and seems to me (as one opposed to the death penalty on general principle) that this might be an instance when it would be acceptable. For both of these individuals.

Fox had an interview this morning with a lawyer who visited the house years ago on minor nonrelated business, who may or may not have seen Jaycee for a few seconds under circumstances that were in no way suspicious. Crazy bastard. Officers should have taken more seriously the 911 call neighbors made a couple of years ago about the kids in the back yard. His parole officer should have searched more over all the years they had Jaycee.
