Hiya,

Poor you. I agree with music loss being like a divorce/moving house – possibly worse. Unless it's music you've gone off, in which case it isn't – but you don't go off decent music.

As somebody who's moving in the near future, a lot of my music will be a link to the house I've lived in, my parents & neighbours, & the life I've lived nearly from birth. Also, I believe your music taste's formed before you ever get into the relationship with said person you end up divorcing. It's always been there, it's like another relationship (no wonder I'm a bit confused.........)

If you copy your own CDs (ones that you own, not necessarily ones that you produced) and do not give away or sell the copies you have done no wrong. You have not even broken any laws (a different matter entirely). The law allows you to make a backup copy. If you make a copy of somebody else's CDs for yourself or give away or sell copies of your own CDs, then you have violated copyright.

This is, of course, my own opinion and not that of an attorney, but that is the way I understand the law.

Oh, I'm sorry. Back on the topic. Losing your music has to be one of the most traumatic events in a persons life. Kinda like divorce or moving from ones home. Mary, I am so sorry and I hope you find a way to get that music back.

I think I know how you must feel. Honey and I had to leave behind an extensive colllection of records we had because when we moved to California, we had no room on the truck and no room in our little condo here. That was very painful and even now I regret what we did.

We saved some but most were lost. Well, we had to make a choice, but at least we had the choice. You didn't.

I have a question. I have "COPIED" some of my CD's down to tapes. Is this also stealing? I have spent most of my nearly 60 years taping music from radios, TV, records, etc. and it was never considered stealing then, was it?

"Let's tape it!" is a phrase I've heard much my life. Are all these people thieves?

How far is it from taping to copying to CD?

Somehow I just don't understand.

Am I the only one who has taped all sorts of entertainment?

Why were tape recorders, CD recorders, etc. allowed to be sold to the public if it is unlawful to use them?

Again, I just don't understand.

Yeah i just had 250 cds stolen out of my car today. Wish i would have caught the person. But maybe its good i didnt. I would be in jail right now for beating them repeatedly

Many good points made in this thread, and despite the argumentative tone of a guest or two, all points are important. The ethics involved aren't sorted out easily, but a good start exists with the various offers people have made.

If you have the cases for the CDs that were in the car then knowing exactly what you lost is very helpful for an insurance claim. The remarks above about homeowners insurance are correct for many places in the U.S.--is that where you are? What auto insurance doesn't cover homeowners (or renters) insurance may cover. And having the cases strengthens your claim. (Meanwhile, if I were you I'd take up Mick and Seamus on their offers--those are too good to refuse!)

Copies for personal use have always been allowed; if a personal use includes a gift (but no exchange of money) then you're into a gray area that GUEST may argue about but would have a hard time defeating. People who make their living selling their CDs will have a different take on this than all of the record companies that just recently opened their warehouses and dumped their unsellable clutter on the nation's libraries as part of a "settlement" regarding their unfair business practices. They'll actually get credit for that CD dump, and they'll have nice clean warehouses for the next batch of trash. But I digress. . .

Check out some of the area half-price book and CD stores. Chances are they won't buy CDs without the cases, and may remember if someone tried to sell some without, or will remember the disks if your collection was unique enough.

I've stopped doing much in my yard or around the neighborhood after dark, even in what seems like a relatively safe neighborhood. My across-the-street neighbor is a retired fellow keeps an eye on the place, and has noticed that if I work in the garage at night that there have been passersby who slow to take a look--it worries him. I take his concern in all of it's various meanings. Is your dog protective? Then the late walks might be okay, but take care of yourself, and consider the missing CDs a slim price to pay if it cautioned you to look out for yourself better.

Maryrrf, 'm sorry for your loss. I know a bit about the mundane subject of property insurance, and after the shock and feeling of violation wears off, you may find yourself wanting some money if you are entitled to it. This is why you paid for your auto and homeowner's policies.

Anyway, a couple of comments suggest that there may be no coverage because the car was unlocked and perhaps the CDs were in plain view. Under any property policy I've ever seen (many), that's wholly irrelevant. A theft is a theft. If the whole damn car was stolen because the keys were on the seat, you could recover. If your home or auto policy provides coverage for theft of personal property (and the former almost certainly does, usually no matter where the stuff is) you've paid for your right to indemnity.

Now, there may be specific provisions that limit your rights. Policies often limit coverage for SPECIFIC things that are easy to lift, like cash or jewelry. But they have to say this. The mere fact that CD theft happens alot means nothing. What matters is what the policy says.

Deductibles are also an issue. But replacing 60 CDs may cost $900 or more, and many policies pay full replacement cost, less deductible. You may not get enough for 60 CDs, but maybe enough for 25.

I hate to prattle on about this. But I hate more the thought that casual and errant advice might keep you from recovering a few hundred dollars if you want it.

I'm truly touched by the PM's I've received from Mudcatters wanting to help. Thank you, all! After sorting through everything I came up with around 15 or so that I really really will miss and want to replace. Others were backups (thankfully) and some (I won't mention any names) I listened to a couple of times and didn't like that much.

I think this has been a good lesson about taking care of things better. I said the CD's were precious to me, but I unthinkingly stuffed them in a CD holder and left them in an unlocked car. Not very smart. It also made me more aware of things that are going on in my neighborhood. I think there are some groups of kids walking around late at night and getting into mischief. As I walked around searching - hoping they'd thrown out the CD's (can you imagine their disgust if they'd popped Jeannie Robinson's unaccompanied singing into the CD player) I noticed small signs of vandalism - a street sign knocked off - a dent in my mailbox, some beer bottles in a ditch. I often go for a walk with my dog late at night and sometimes leave my door unlocked while we're out - I won't be doing that any more - at least I'll lock the door. And I often sit around in my house with the door unlocked, but I won't now.

Oh and I will make backup copies of CD's that I want to listen to in the car.

Exactly. Where the ice cream analogy breaks down is that she doesn't have to steal the CD from the performer, she gets a copy from a friend. In the Ice Cream scenario, she would be stealing the Ice Cream itself (not merely the rights to use the Ice Cream), and that entails an actual LOSS to the merchant. In the case of the music, there is no loss to the artist or record company, and no profit either.

The analogy would be (let's say): my child has a cup of "Cherry Garcia" Ice Cream which gets stolen. I say "well, come on back to the house, I have all the ingredients and I'll make you up a cup of ice cream that's just as good as Cherry Garcia."

Cherry Garcia is (I guess) a proprietary combination of elements, so I'm ripping off their PATENT, theoretically. But I paid for the ingredients, and I'm not taking anything away from the Ben and Jerry's company. (It's a bad analogy, but only because the Ice Cream analogy was inherently bad to begin with.)

Unless it was another folkie who stole your CDs - and on the whole that's probably not too likely, I'd would think that they'd get rid of them quite quickly. Check the area around where you left the car - they might have been dumped nearby as soon as the thief had a chance to find out what they'd stolen. The suggestion about local second-hand/charity shops is also worth checking out.

I've had my car broken into several times and twice found the items dumped in the nearest hedge, because the thief didn't want them. I'm pretty sure that most of our local car-crime yobs would be terrified of the shame and loss of street-cred that would ensue if any of their friends found them in posession of FOLK MUSIC CDs !

I wonder how many re sales of CDs etc. are generated by the theft of an original. If it is a common occurence, should the performers consider giving the thief a cut from their royalties? They are after all, providing a sale that he/she would not have made otherwise. Is making CDs encouraging crime?
I would be more upset if the victim of the theft decided not to bother replacing my CD, as it wasn't that good anyway.

It's not so convenient but the safest thing is to keep the case in the boot, or take it in the house with you at night. I've worked with motor and household claims in the past and have seen how common this sort of theft is.

I'm a little puzzled by the recriminations from GUEST, who does not want anyone to send the unfortunate Maryrrf copies of her stolen CD's, which she once legitimatly owned.
Copying recordings FOR YOUR OWN USE (such as in the car) is perfectly legal, even sensible, and if she HAD burned copies for them, the loss would have been only that of the trouble of replacing them. If someone burns copies for Maryrrf, and then she burns further copies for her own at-home use, she will only have what she originally paid for. It isn't the same thing at all as burning pirate copies.

I would suggest that the theft be reported, though. Some public-spirited person may find them and turn them in. Yes, they do still exist.
Mind you, anyone so inclined might be more likely to break into a car to nick copies than even originals, as they could be ANYTHING.

I can't imagine a performer who wouldn't feel bad enough for you or be anal-retentive enough to bitch about a copy under these circumstances, and many would just give you one. They send free CDs off to venue bookers and radio show hosts who may not even listen to them. What's one free CD, when it's going to someone who liked their music enough to buy the recording in the first place and then had it ripped off?


If it were me, I'd be very upset about losing my music, and quite miffed about somebody using my loss as an excuse to get on a soapbox. I guess if we have the ability to feel compassion, we ought to try a little harder to make up for those who can't. There ain't that many of 'em.

I more than likely won't have a copy (the legally purchased type), but I'd like to try to help anyway.

A little calm is needed here, folks. And a little reason. While I dislike the GUEST posts, this position is not incorrect. The analogy of the corner store was a correct analogy.

I would prefer folks not copy my CD, but due to the great example of Seamus, I see a better way.

The point of the GUEST post is that it is not your call on the copy. You may give yours away, but you may not burn it and give it away. That is stealing. I, on the other hand, can give my work away IF I CHOOSE. And I choose to do this to help out someone who is a victim.

Those who have no investment in the matter find it easy to call others grudging bastards. My suspicion is that most artists would be happy to help someone who has been victimized. But they don't want to be victimized themselves in doing it.

I am happy to send Mary mine, and any doubles I have. Thanks for the inspiration, Seamus.

Mary don't feel bad, that's what the nit picking Guest wants you to do. We all know that copying CDs is bad practice, but there comes a time when turning a blind eye is called for, and that's where we're at now.

Oh my god I cannot believe how this thread has escalated and turned nasty. Please take this discussion of copying CD's to a different thread. I hate to think that this posting started another Mudcat argument. So as not to inflame things more I will not post a list of what got stolen, although I appreciate the offers to help. Anyway now that I've taken stock: some of the CDs(thankfully) were backup copies, and I had transfered a number of my favorite songs onto my hard drive.   I've narrowed down the list of CD's I don't want to live without and will replace them gradually. One good thing is that I still have the liner notes and lyric sheets of most of them, since they were all in the CD holder.

For the record - I have a CD out and if somebody bought one and then lost it I would not object under those circumstances to their friend making a copy and replacing it. That is a little different than just wholesale making copies of CD's and handing them out.

Thanks for the good thoughts and offers, everyone.

Please, can't we all just get along??????!!!!!

Any musicians out there want to object non-anonymously, so maryrrf knows not to copy your CDs?

Here is my take: the artists got a royalty from you already. They could not reasonably expect that you would buy another copy of their CD for yourself. So why should THEY make money off the crime, any more than the criminal?

Why don't you say what your favorite types of music is/are and peopel might have extra ones they don't listen to any more. I have a collection of about 5 cds but I can spare you one of them..of course it probably will be scratched etc.

And I just can't believe someone other than Guest would deny you a copied cd in this situation...maybe you can email your favorite musicians and ask what they think and if it is OK.

Thanks for the sympathy, folks. Yes it was around 60 CDs and it was stupid to carry so many in the car. I had a CD carrier that held that many and I'd just keep bringing more out - I enjoyed having a big selection to choose from while I was driving. I don't think I'll put in an insurance claim - I have a big deductible and after all the car was unlocked. But it wasn't out on the street, it was in the driveway right next to my back door, which gives me the creeps. I've walked around the neighborhood hoping the little bastards might have been disgusted with the music selection and thrown that CD holder out - but of course that's a long shot. I'll try the poster/flyer idea.

What bothers me is: 1) My son was always telling me to lock the car, even if it was in the driveway (I will from now on!) 2) For several weeks I had been meaning to organize those CDs and make back up copies to carry in the car rather than the originals. I believe it is legal to make an extra copy for yourself of a CD you've bought.

On the bright side - some of the CD's were backup copies, and I had copied some of the songs out of the collection on to my hard drive so I could listen while I was at the computer. And the other good thing is that I learned a lesson and will be more careful in the future.

But it still ruined my day!

This happened to my son, too. Had his collection of favorite CDs in the car one night and they were gone in the morning...about 60 of them. Our homeowner's policy would not cover CD theft since, as they told us, it happens so often. Pity. I'm sorry about your collection, Mary. It's hard to lose them, and harder yet to deal with the unfairness of theft.

Look in the local second hand shops - a lot of CDs were stolen from a library I worked in, and just by chance I went into a second hand shop and found a whole load of them, still barcoded, sitting on the rack for sale!

Very sorry, Maryrrf. Not a huge tragedy in the scheme of things, I know, but definitely big enough to take the shine off the day. I still occasionally find myself missing treasured LP's stolen from my apt. years ago.

Putting up flyers worth a try, nothing lost...and leaving easily portable goodies visable in a vehicle, locked or unlocked, on the street overnight probably not a good idea. Even a locked car can be easily broken into, and then there are car repairs on top of loss.

I don't have a CD burner but I'd be glad to make you a tape of anything I have that you lost. I think most recording artists would not take this amiss under the circs. Let us know....

Here is a suggestion: put some posters around the neighbourhood that you are prepared to buy back your CD's, well you would write it as "reward offered for return of the CD's stolen from my car". The thieves are probably just looking for money anyway so they win and you win. You risk giving them the idea for a future scam, I suppose, but it only really works when the stolen items are unique.

Real life example:

Not long ago someone went into the local art gallery, which is owned by a friend of mine and which she had only just opened. This "someone" - we found out through the neighbourhood who it was fairly quickly, i.e. within hours - just walked straight in, chatted to the owner, looked at the catalogue of artworks, waited until she went out into the other room and stole an artwork off the wall. It was the one with the highest price tag (which in my humble opinion wasn't "art" but that's another story). He also stole a small Papier-Maché figure. Neither of these items would have been able to be flogged off among his mates or down the pub or at the pawn shop so he was totally stuck with his prizes.

Even though the obvious thing to do was to go and report it to the Police and let them handle it, my friend and her husband knocked on the perp's door and offered him $100 for the two artworks and he handed them over. She did promise not to tell the Police, but we convinced her afterwards to let them know who it was. He was already well-known to them and wanted for a few other offences.

I was lucky that when my house was broken into many years ago that my Martin wasn't stolen. Everything taken was very easy to replace.

Now all of the CD's in my van are copies. It's rare that I have more than two or three originals with me. I'm on vacation now and if my 40 or so CD's I have with me disappear I'm only out the time it took me to burn them.

I'm sorry to hear about your loss.

60 of them! Good God. That's a lot of CD's to keep in your car. I bet the people who stole them are not overly thrilled with the selection. They were probably looking for Britney Spears and Metallica. I sympathize with your loss.

I have a couple of chanting and spiritual talk CD's in my car at the moment. Can you imagine how disgusted the thieves would have been if they'd stolen those? I also had some Elvis and Dylan there, though, and they probably would figure those were okay.
