B-dubs...no contract involved, just a "freedom of speech" issue in a suit by (ostensbly) civil rights types. They regarded the owner as a "reactionary" and someone who was being "judgemental" and therefore had to be taken down a peg. The contention was that the motel, like a shopping center, was open to the public, and that not allowing access to "pay-per-veiw" porn violated the freedom of speech.

Comcast now charges 5 to 7 dollars for on demand movies even if they are Godfather 1 or some other 30 year old movie
But the 'Adult' on demand fee is $15 Dollars for a 8 minute "movie"

That fee structure is way below the belt ;> }

I reserve making judgements about right or wrong until presented with a bit of factual information. I endeavored to find said information using Google and had no success. Ball's in your court.

Having said that, I would be willing state that:

1) IF the motel owner originally contracted to provide pay-per-view porn to his guests and later changed his mind, he's wrong, the court's right.

2) IF the motel owner didn't realize he was signing a contract to provide pay-per-view porn, he's an idiot, the court's right.

3) IF the motel owner originally contracted to provide pay-per-view movies but NOT porn to his guests, and the pay-per-view people tried to tack the porn on after the fact, they're slimeballs, the court's wrong.

I don't know which, if any, of the above scenarios applies to the case. Hence, as stated above, ball's in your court.

Nobody said that motel owners had to provide porn. They were told that the "pay-per-view" supplier had to be allowed access to the motel customers. They could choose to use it (or not). Of course the motel gets a cut of the $$$ and with some motel chains that is all that keeps them from going broke. The owner in question said he had a right to run his business his way, financial consequences and all.

Still, is anyone going to say that the court's decision was wrong?

I find it hard to believe that a court would require pornography to be furnished by anyone to anyone, except perhaps by a business representing themselves as providers of porn, and collecting a fee for said provision.

I'm pretty sure BWL hit the nail on the head when he guessed that it must have something to do with the motel-chain's contract with a pay-per-view provider. I'm sure that a lot more payments are tendered for a lot more views of porn than of other stuff ~ in motels, anyway, for crying out loud.

Let's get back to that "15% Canadian" requirement.

For your basic one-on-one sexually-explicit scenario, it's gotta be either 100%, 50%, or zero-percent Canadian. To comply, either one or both participants would need to be Canucks, in either case far exceeding the required 15%. How could an economy-minded porn producer just get by by "barely" meeting the legal minimum?

A seven-person orgy featuring a single Canadian would come in at 14.285714...% Canadian, not quite up to snuff. One Canadian out of six would just pass muster at 16-2/3%. I suppose that'd be the way to go...

One might hope so, but that is not the case. Google searches give you what you are expected to read. They are doctored. Remember, before the Olymiics, all anti-China articles (at least on certain subjects) stopped showing up on searches?

BTW, is anyone actually saying that the court decision was bad or just that it did not happen? Those are different issues.

5. To make stamps and money. And so that we have a flag.

Nope, I don't believe it was anything but an owner who objected to porn on moral grounds and felt he had the constitutional right to operate a moral business. Can a stop owner ban smoking on his property? Ban guns? Ban drug use? Ban drinking? I think they can.

I suspect that the issue is more a matter of breach of contract than free speech or governmental abuse. When a hotel guest buys a pay-per-view movie, the revenue is split between the hotel and the pay-per-view provider. The exact cut is determined by a contract and is based upon volume. Generally speaking, the more volume, the higher the cut for the hotel. So, if someone signed a contract agreeing to carry all content provided by a pay-per-view provider, adult content included, they'd probably get a better deal than someone who contracted to carry only mainstream movies. If they later tried to weasel out of carrying the porn without renegotiating the contract they'd be guilty of a serious breach of contract.

A lawsuit was filed and the court orderd the motel chain to offer porn is each and every room, under threat of penalties if they did not.
